General Terms
Before using AIZEN services, you are required to agree to these AIZEN Rent-to-Own Terms of Use and register through the Application.
When you:
register for the first time as a prospective Borrower; and
sign the Loan Agreement;
you are required to carefully read, understand, comprehend, and review the AIZEN Rent-to-Own Terms of Use, and you are required to follow the applicable authentication and verification processes and steps.
AIZEN Rent-to-Own, or any reference to it as “Rent-to-Own,” is a service in the Application or through the Official Application Partner that provides information technology-based rent-to-own facilities through AIZEN as the Rent-to-Own Provider, by providing rental payment options as follows:
by providing rent-to-own services using motorcycles under AIZEN’s name. Rental payments together with Service Fees, if any, are made through daily rental payments via the AIZEN application or an appointed partner application (“AIZEN B2C”);
by facilitating the provision of rental services from the Rental Service Provider(s) by forwarding the rented motorcycle to you as the Rent-to-Own Service User. Therefore, the legal relationship arising in relation to the Rent-to-Own Facility and Bills is fully borne by you as the Rent-to-Own Service User and the Rental Service Provider(s). Rental payments together with Service Fees, if any, are made through automatic deductions from the digital wallet feature in the acquisition affiliate partner application (“AIZEN B2B2C”).
AIZEN B2B2C and AIZEN B2C are hereinafter collectively referred to as “AIZEN Rent-to-Own.” The provisions set out in these AIZEN Rent-to-Own Terms of Use generally apply to the use of AIZEN B2C or AIZEN B2B2C services, as relevant, provided that the Rent-to-Own Facility for each AIZEN B2C or AIZEN B2B2C service shall be subject to the terms and conditions agreed upon and further regulated in each respective rental agreement, depending on the AIZEN Rent-to-Own service you use.
Your approval of these AIZEN Rent-to-Own Terms of Use shall be deemed to be, and shall constitute, an application to obtain the AIZEN Rent-to-Own Facility.
You acknowledge, understand, and agree that AIZEN, for the benefit of AIZEN and/or on behalf of the Rent-to-Own Service Provider(s), has the right to conduct checks, verification, evaluation, assessment, and determine whether to approve or reject your application to obtain the Rent-to-Own Facility.
You understand that failure by a Rent-to-Own Service User to fulfill rental payment obligations may result in: (i) collection activities being carried out by AIZEN and/or the Rent-to-Own Service Provider(s), or other parties appointed by AIZEN and/or the Rent-to-Own Service Provider(s), against the Rent-to-Own Service User; and (ii) records or creditworthiness ratings of the Rent-to-Own Service User with AIZEN and/or the Rent-to-Own Service Provider(s).
You agree to the use of Electronic Signatures provided or facilitated by AIZEN or other parties cooperating with AIZEN.
AIZEN will and may report to relevant parties, including but not limited to OJK, PPATK, and/or relevant agencies, in the event that any information, data, or statement provided by you is incorrect, violates, or contradicts the Law.
These AIZEN Rent-to-Own Terms of Use, in whole or in part, including any features or services, may be amended, modified, or added to from time to time at our sole discretion by providing Notification to you, either through notices or announcements in the Application, email, your phone number registered in the Application, and/or other communication media.
You are deemed to have agreed to such changes when you continue to use AIZEN Rent-to-Own services after the effective date of such changes, modifications, and/or variations. If you wish to reject such changes, modifications, and/or variations, you must stop accessing or using AIZEN Rent-to-Own and/or our services, provided that you are required to first settle and fully pay all outstanding or unpaid obligations.
Rent-to-Own Terms
Principal Rent-to-Own Terms
The provisions and terms set out in Section 2 of these AIZEN Rent-to-Own Terms of Use refer to and are subject to the Rent-to-Own Agreement.
Verification
You may be requested to submit additional documents or information, either electronically or directly to our office, or to meet our agent, as instructed by us, if you wish to use AIZEN Rent-to-Own services or as otherwise required.
We will verify the information and documents that you submit through the Application and/or Official Application Partner and determine whether you have met the requirements as an AIZEN Rent-to-Own user.
AIZEN will verify, check, review, and assess any information, data, and statements provided by you, including by cooperating with third parties to verify and assess eligibility for the Rent-to-Own application.
Approval and/or rejection of your verification application is entirely within our authority, taking into account the provisions of applicable laws and regulations. We may, at any time, withdraw approval of your verification application and return your Account status to unverified, including if there is doubt regarding the accuracy and/or validity and completeness of the documents and/or information you submit.
To avoid any misuse of your Account, we may terminate any service if the documents or information we request from you are inaccurate, invalid, and/or incomplete.
Rental Fees and Payments
Rent-to-Own Service Users will be charged Rental Fees for each rent-to-own service received, as further regulated in the Rent-to-Own Agreement.
Activation of the AIZEN Rent-to-Own Service by the Rent-to-Own Service User constitutes approval to make rental fee payments through an AIZEN account or other methods instructed by AIZEN.
Maintenance and Security of the Leased Motorcycle
You are required to carry out regular monthly motorcycle maintenance at electric motorcycle maintenance locations appointed by AIZEN, on dates and days that will be further notified to you.
You are required to maintain and take care of the AIZEN Rent-to-Own Motorcycle so that it remains in good condition, as it was at the time of vehicle handover.
AIZEN may request clarification from you if it finds that the motorcycle is located more than 100 km from your domicile location, and you are required to provide truthful information regarding your location and reason for travel.
You are required not to lend, rent out, sell, transfer, assign, or otherwise release rights over the vehicle, or encumber the vehicle by pledging it again or providing any other security over it, without prior written approval from AIZEN.
Default
If you fail to fulfill the agreed rental payment obligations for a period of 3 (three) consecutive days, you agree to be declared in default and therefore agree to AIZEN or another appointed party taking action to deactivate the vehicle battery so that the vehicle can no longer be used by you.
If within 2 (two) days from being declared in default you have not made payment, AIZEN has the right to terminate the Rental Agreement and you are obligated to return the Leased Vehicle Object together with its Vehicle Registration Certificate/STNK to AIZEN.
AIZEN Privacy Policy
By agreeing to these AIZEN Rent-to-Own Terms of Use, you declare that you have read and agreed to the AIZEN Privacy Policy. Therefore, you are required to carefully read, understand, and comprehend the AIZEN Privacy Policy.
Other Terms
By agreeing to these AIZEN Rent-to-Own Terms of Use, you declare that you have read and agreed to other terms in connection with the Rent-to-Own Facility.
Rights and Obligations of the Parties under the AIZEN Rent-to-Own Terms of Use
Rights and Obligations of AIZEN
Without prejudice to other rights and obligations set out in these AIZEN Rent-to-Own Terms of Use, the rights and obligations of AIZEN as the Rent-to-Own Provider are as follows:
AIZEN has the right to obtain, collect, use, store, process, disclose, and transfer to other parties, in the context of providing services and the Rent-to-Own Facility, your Information that has previously been submitted or provided to AIZEN in accordance with the AIZEN Privacy Policy; and
AIZEN is obligated to carry out all provisions in these AIZEN Rent-to-Own Terms of Use in connection with the provision of the Rent-to-Own Facility.
Your Rights and Obligations
Without prejudice to other rights and obligations set out in these AIZEN Rent-to-Own Terms of Use, your rights and obligations are as follows:
Subject to the results of verification, checks, review, and assessment by AIZEN, you have the right to obtain the Rent-to-Own Facility and use the electric motorcycle based on the Rental Agreement and these AIZEN Rent-to-Own Terms of Use;
You are obligated to notify AIZEN and update any changes to your Information, data, and statements provided to AIZEN or uploaded to the Application from time to time;
You are prohibited from taking any actions that harm and/or may harm AIZEN and/or the Rent-to-Own Service Provider(s), including damaging their reputation in any way, as well as abusive and/or fraudulent actions or transaction patterns identified by the AIZEN system as suspicious financial transaction patterns;
You are required to comply with all terms and conditions, usage policies, and privacy policies applicable to products and/or services on the Application and Official Application Partner;
You are required at all times to consider the amount of Rental Fees and any fees that must be paid according to your ability to repay the Rent-to-Own Fees, and to consult with other parties if necessary before applying for and obtaining the Rent-to-Own Facility;
You are required to cooperate and provide any necessary information to OJK, the government, and other law enforcement authorities, in the event that any information, data, or statements provided by you contradict Applicable Law; and
You are prohibited from misusing AIZEN Rent-to-Own services for activities related to money laundering or terrorism financing, money politics, violations of social norms, funding groups prohibited under Applicable Law, trading illegal drugs, including narcotics or psychotropic substances, and/or other activities that violate Applicable Law, collectively referred to as “Legal Violations.”
You hereby understand and acknowledge that: (i) AIZEN has the right to report to the relevant authorities in accordance with Applicable Law if AIZEN finds indications of Legal Violations by you or if you are legally proven to have committed Legal Violations; and (ii) AIZEN has the right to block your Account and/or repossess the motorcycle currently under the rental period, as relevant.
Environmental Credits. All carbon credits, emission reduction units, and other environmental instruments generated from the ownership, operation, or use of the leased vehicle, whether under domestic frameworks such as SPE-GRK or SRN-PPI, or international voluntary or regulatory frameworks, shall be the sole and exclusive property of AIZEN. You irrevocably assign to AIZEN all rights, title, and interest in such Environmental Credits, and you agree to cooperate by providing vehicle usage data, mileage, and charging records as required.AIZEN reserves the right to update or modify these terms as necessary to comply with changes in laws, regulations, or market conditions related to Environmental Credits.
You hereby irrevocably assign, transfer, and relinquish to AIZEN all rights, title, and interest in any Environmental Credits arising from:
a. your use, operation, or charging of the Vehicle;
b. the displacement of greenhouse gas emissions that would have occurred from the use of a fossil fuel vehicle; and
c. any other environmental benefit arising directly or indirectly from this Agreement.
This assignment is unconditional and irrevocable.
AIZEN shall have the exclusive right to register, certify, sell, trade, transfer, or retire the Environmental Credits through any registry or market, whether domestic or international. AIZEN may assign or pledge such rights to any third party, including lenders, investors, or project partners, without further consent from you.
You agree to:
a. not claim, register, sell, or assert any ownership over any Environmental Credits;
b. cooperate with AIZEN by providing vehicle usage data, mileage records, charging information, and any other documentation reasonably required to verify and certify the Environmental Credits, at no additional cost to AIZEN; and
c. make no public statement, sustainability claim, or environmental disclosure regarding emission reductions from the Vehicle without the prior written consent of AIZEN.
You acknowledge that no separate payment or royalty shall be due for the Environmental Credits. All related revenue shall belong solely to AIZEN. Both parties agree to comply with all applicable laws and regulations relating to environmental credits in the jurisdictions where the Vehicle operates. AIZEN reserves the right to update this Section as necessary to reflect changes in applicable law or market standards, with written notice to you.
